Currently there are developed two versions of the draft Law of Ukraine "On Amendments to Some Laws of Ukraine regarding the maintenance of competitive conditions of electricity generation from alternative energy sources". First edition developed by the State Energy Efficiency Agency and is undergoing negotiation with relevant ministries and agencies (conditionally "government" edition). The second — written by the authors under coordination of member of Parliament A.G. Dombrovskiy and being prepared for registration at the Verkhovna Rada (conditionally "parliament" edition).
UABio supports both version of the draft law. We would like to clarify UABio position concerning green tariff level for electricity generated from biomass and biogas in the abovementioned draft laws.
We believe that the green tariff rates set by the two version of the draft law for electricity from biomass and biogas are comparable and, in fact, are equal:
• The proposed green tariff rate according to the parliament edition: for power from biomass — 2.84, for powerof biogas — 3.15. That is 5% higher than the rates proposed in the government's version of the draft law: biomass — 2.7, for biogas — 3.0.
• At the same time, parliament edition of the draft law provides that "the volume of electric energy produced from alternative energy sources ... are determined at the volume except for the volume of electricity for own needs in electricityof such objects in each billing period (month)." No such requirement is set in the government edition, under which all generated electricity can be sold at a green tariff, and any company can buy power for its own needs at the usual tariff.
• Normally, the consumption of electricity for its own needs for companies generating power from biomass or biogas, are more than 10%. Accordingly, the parliament edition of the draft law reduces the amount of income for companies generating power from renewable energy sources by about 10%.
Thus, the increase of green tariff rate in the parliamentary version of the bill is completely leveled by requirement on the volume of electricity supply with the exception of electricity for its own needs.
Accordingly, UABio position on the subject actually remains unchanged and is based on technical and economic calculations of the Associations experts.
